Petice „Mayday Žvahov 2011“
Správní rada a výkonné vedení konzervatoře Taneční centrum Praha se obracejí na Úřad Městské části Praha 5 (dále jen „radnice“), aby garantoval její sídlo ve školním areálu Žvahov a pokračoval v jeho postupné revitalizaci podle schválených dokumentů. Radnice vydala oficiální záměr pronájmu a na základě usnesení Rady MČ vypracovala a předložila konzervatoři TCP dne 11.10. 2006 nájemní smlouvu, kterou ale v červnu 2010 sama zpochybnila a soud ji dne 9.11. 2011 prohlásil za neplatnou. Vinou radnice je tedy TCP ve svém sídle již pět let údajně „bez právního důvodu“ a mělo by školní areál do 15. 7. 2012 vyklidit.
To považujeme za nepřijatelné, protože obecní úřady musí řádně spravovat obecní majetek, včetně profesionálně zajištěných právních a administrativních úkonů. Proto konzervatoř TCP v dobré víře ve veřejnou samosprávu všechny její právní kroky bezvýhradně přijala, nájemní smlouvu podepsala a její podmínky dosud důsledně dodržuje. Formální chyby v nájemní smlouvě radnice způsobila zřejmě záměrně, aby ji mohla kdykoliv sama vypovědět a dále volně manipulovat s obecním majetkem - atraktivním areálem na hranici chráněné krajinné oblasti Prokopské údolí.
TCP do zanedbaného areálu muselo investovat již přes 4 mil. Kč, zajistilo jeho (neexistující!) stavební dokumentaci, čtyři projekty rekonstrukce a k „technickému zhodnocení“ obecního majetku motivovalo řadu partnerů, sponzorů a rodičů. Při správě areálu ale TCP v roce 2007 upozornilo radnici na mnohonásobné předražení nákladů, protekcionizmus a korupční chování – a místo nápravy muselo brzy čelit šikaně, nekorektním zásahům do provozu, poškozování svého jména .... a žalobě na vyklizení z areálu. Nezbývá, než odvolat se k nejvyššímu a ústavnímu soudu, případně k mezinárodním soudním orgánům a ihned upozornit kontrolní orgány města a státu.
Postup radnice lze považovat za zřejmé „porušení etiky veřejné služby“ z hlediska politického, právního i morálního. TCP patří svými výkonovými ukazateli mezi nejaktivnější evropské konzervatoře a jako významná vzdělávací a umělecká instituce má dlouhodobé závazky vůči orgánům státní a regionální správy, rodičovské a odborné veřejnosti. Proto musí důsledně usilovat o reprezentativní sídlo a jeho efektivní správu ..... ale především o slušnou, demokratickou občanskou společnost. To TCP v období 2005 – 10 v Praze 5 nepochybně prokázalo a nyní pouze žádáme, abychom v tom mohli bez obstrukcí a intrik pokračovat. Konzervatoř Taneční centrum Praha už udělala vše, resp. podstatně víc, než by se od jakékoliv školy dalo očekávat … teď už mohou tuto kauzu korektně vyřešit pouze zdravý rozum a čisté ruce!

Petition „Mayday Žvahov 2011“
Der Verwaltungsrat und die exekutive Führung des Konservatoriums „Tanzzentrum Prag“ wenden sich am Amt des Stadtviertels Prag 5 (weiter nur „das Rathaus“), damit es ihren Sitz im Schulareal Žvahov garantiert und damit es in seiner fortschreitenden Revitalisation nach den genehmigten Dokumenten weiterführt. Das Rathaus erlässt die ofizielle Absicht der Vermietung und aufgrund des Beschlusses des Rates des Stadtviertels arbeitete aus und lag dem Konservatorium „Tanzzentrum Prag“ am 11.10.2006 den Mietsvertrag vor, den er aber im Juni 2010 selbst in Frage stellte und das Gericht erklärte ihn am 9.11.2011 für ungültig. Dank der Schuld des Rathauses ist also „Tanzzentrum Prag“ in seinem Sitz schon 5 Jahre angeblich „ohne juristischen Grund“ und es sollte das Schulareal bis zum 15. 7. 2012 ausräumen.
Das halten wir für unakzeptabel, weil die Gemeideämter ordnungsgemäß den Gemeindebesitz verwalten müssen, insgesamt der professionell garantierten juristischen und administrativen Handlungen. Deshalb nahm das Konservatorium „Tanzzentrum Prag“ im besten Glauben an die öffentliche Verwaltung alle ihren juristischen Schritte vorbehaltlos an, das Konservatorium unterschrieb den Mietsvertrag und es hält seine Bedingungen bisher konseqvent ein. Formale Fehler im Mietsvertrag verursachte das Rathaus offenbar absichtlich, um ihm jederzeit selbst aufkündigen und weiter frei mit dem Gemeindebesitz manipulieren zu können – mit dem attraktiven Areal an der Grenze des Naturschutzgebietes des Prokop – Tals.
Das „Tanzzentrum Prag“ musste ins vernachlässigte Areal schon über 4 Millionen Kronen investieren, es stellte seine (nicht existierende!) Baudokumentation fest, es motivierte vier Projekte der Rekonstruktion und zur „technischen Bewertung“ des Gemeindebesitzes viele Partner, Spender und Eltern. Bei der Verwaltung des Areals machte das „Tanzzentrum Prag“ im Jahre 2007 das Rathaus auf die vielfache Überteuerung der Kosten, den Protektionismus und das Korruptionsverhalten aufmerksam – und anstatt der Besserung musste es bald der Schikane, den unkorrekten Eingriffen in den Betrieb, der Beschädigung seines Namens …. und der Anklage gegen das Ausräumen aus dem Areal gegenüberstehen. Es bleibt nicht übrig, als sich zum Höchsten und zum Verfassungsgericht, bzw. zu den internationalen Gerichtsorganen zu berufen und gleich die Stadt- und Staatskontrollorgane aufmerksam zu machen.
Es ist möglich, das Verfahren des Rathauses für die evidente Beschädigung der Ethik des öffentlichen Dienstes in Bezug auf Politik, Recht und Moral zu halten. Das „Tanzzentrum Prag“ gehört mit seinen Leistungskennzahlen zu den aktivfähigsten europäischen Konservatorien und als bedeutende Bildungs – und Kunstinstitution hat es langfristige Verbindungen gegen die Organe der Staats – und Regionalverwaltung, auch gegen die elterliche und fachliche Öffentlichkeit. Deshalb muss es sich konseqvent um den repräsentativen Sitz und seine effektvolle Verwaltung …. aber vor allem um die anständige demokratische bürgerliche Gesellschaft bemühen. Das bewies das „Tanzzentrum Prag“ in den Jahren 2005 – 2010 in Prag 5 zweifellos und wir bitten nur jetzt, darin ohne Obstruktion und Intrigen fortfahren zu können. Das Konservatorium „Tanzzentrum Prag“ machte schon alles, bzw. wesentlich mehr, als man von beliebiger Schule erwarten könnte. Jetzt können diese Causa korrekt schon nur gesunder Verstand und saubere Hände auslösen!

Petition „Mayday Žvahov 2011“
The board of directors and executive board of the Dance Centre Prague, Conservatory address the Prague 5 Municipal authorities with a request to safeguard its residency at the school location Žvahov, and to continue in its revitalisation according to already accepted documents. The municipal authorities announced officially set purpose for leasing, and on October 11, on the base of council resolution, they proposed and put forth to DCP a lease contract which, in June 2010, they themselves impeached; and the court nullified it on November 11, 2011. Reportedly, Dance Centre Prague has already been staying at its seat with no legal ground, due to the authorities fault, for five years, and it should leave its school premises by July 15, 2012.
We take it as inacceptable because the municipal authorities must duly manage the municipal property, including professionally secured liability of legal and administrative acts. Therefore the DCP, in good faith with public self-government, accepted implicitly all its legal steps, signed the lease contract, and is still keeping its conditions. Formal errors in the contract were evidently made on purpose to be able to denounce it at any time and to manipulate freely with the municipal property – attractive premises at the border of protected landscape area Prokopské údolí.
DCP had to invest to this neglected area over four million CZK; had to have made (not existing!) building documentation, four projects for its reconstruction; and also motivated considerable number of partners, donators and parents to promote its “technical betterment” of municipal property. While conducting the building administration in 2007, DCP gave notice to the municipal authorities to draw their attention to multiple overpriced costs, protectionism and corruptive behaviour – and instead of redemption it soon had to face chicane, incorrect intrusions to its management, waste of its name .... And last but not least, action at the suit of evacuation from the premises. There is no choice but to appeal to the Supreme Court or the international court bodies, and immediately draw attention to the city and state auditing bodies.
These authorities’ proceedings can be taken as evident neglect of “public service ethics” as seen from the political, legal or moral point of view. As far as the performance indicating instrument is concerned DCP belongs to the most active European conservatories, and as an important educational and artistic institution it has longstanding obligations towards the state and regional administration, parental and professional public. Therefore it must thoroughly urge for a representative residency and its effective management ... but above all to seek for respectable democratic civil society. DCP during the years 2005 – 10 proved it with no doubt. We only require now to let us continue without obstructions and machinations. Dance Centre Prague, Conservatory has already done everything, in fact a lot more than could be expected from any school ... and only common sense and clean hands can solve this case now!
